Agreement to Terms

These Terms of Service are a legally binding agreement between you and [WASH HUB LEGAL ENTITY NAME], a [Massachusetts limited liability company / Massachusetts corporation / other entity type] doing business as Wash Hub.

These Terms govern your access to and use of the Wash Hub websites, software platform, QR checkout workflows, customer app or mobile web experiences, payment and membership features, operator dashboards, support tools, and related services (collectively, the “Services”).

By accessing or using the Services, creating an account, submitting a form, scanning a Wash Hub QR code, purchasing a wash, joining a membership, or otherwise using the Services, you agree to be bound by these Terms.

If you do not agree to these Terms, do not access or use the Services.

If you use the Services on behalf of a company, car wash operator, organization, or other legal entity, you represent and warrant that you have authority to bind that entity to these Terms. In that case, “you” and “your” refer to that entity.

Our Privacy Policy describes how we collect and use information in connection with the Services.

Massachusetts-Based Business Notice

Wash Hub is operated by [WASH HUB LEGAL ENTITY NAME], a [Massachusetts limited liability company / Massachusetts corporation / other entity type] based in Massachusetts.

These Terms are drafted for a Massachusetts-based software business and are governed by the laws of the Commonwealth of Massachusetts, except where applicable law requires otherwise.

Wash Hub may provide Services to car wash operators and end users located outside Massachusetts. Operators are responsible for complying with the laws applicable to their own business locations, customer relationships, memberships, pricing, taxes, advertising, consumer disclosures, and physical car wash operations.

Definitions

Operator
A car wash owner, operator, business customer, or other entity that uses the Services to offer washes, memberships, fleet accounts, or related offerings to end users.
End User
A customer or other individual who scans a QR code, purchases a wash, joins a membership, manages an account, or otherwise uses Operator offerings through the Services.
Customer Data
Information relating to end users or customers that an Operator collects, uploads, generates, or processes through the Services.
Operator Data
Information relating to an Operator, its business, locations, staff, configurations, pricing, or operations submitted to or generated through the Services.
Payment Processor
A third-party payment service provider, such as Stripe or another processor, used to process payments, refunds, chargebacks, or recurring billing.

Eligibility and Authority

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an Operator account or enter into these Terms on behalf of a business. End users must have the legal capacity to make purchases and, where applicable, authorize recurring charges.

You represent that all information you provide is accurate and that you have the authority to use the Services and bind your organization, if applicable.

Description of Services

Wash Hub provides software and digital workflows that may include:

  • QR checkout and mobile payments
  • Membership signup and management
  • Recurring billing support
  • Customer self-service account tools
  • Customer app or mobile web experience
  • Operator dashboard
  • Multi-location management
  • Fleet and commercial account management
  • Promotions and offers
  • Reporting and analytics
  • Payment processor integrations
  • Email or SMS notifications
  • Car wash package management
  • Customer records
  • Business and customer support tools

Wash Hub provides software and digital workflows. Unless expressly stated in a signed written agreement, Wash Hub does not own, operate, manage, or control physical car wash locations.

Relationship Between Wash Hub, Operators, and End Users

Wash Hub is not a party to the transaction between an Operator and an end user, except where Wash Hub acts as a payment facilitator or service provider as described in these Terms or a separate written agreement.

Operators are solely responsible for their car wash services, pricing, packages, memberships, customer support, refunds, cancellations, taxes, disclosures, and physical operations. End users should direct service-related questions, complaints, and disputes to the applicable Operator, subject to applicable law.

Accounts and Registration

You may need an account to access certain features. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly of any unauthorized access or suspected security incident.

Wash Hub may refuse registration, suspend accounts, or require additional verification where reasonably necessary for security, legal compliance, or risk management.

Operator Responsibilities

Operators are responsible for all activity under their accounts and for their use of the Services.

Operators agree to:

  • Provide accurate business and location information
  • Maintain accurate wash package, pricing, fee, tax, and membership details
  • Honor customer purchases and memberships
  • Clearly disclose membership terms, renewal terms, cancellation policies, refund policies, restrictions, and fees
  • Comply with Massachusetts consumer protection laws where applicable
  • Comply with applicable fee disclosure and pricing transparency requirements
  • Obtain all necessary rights, consents, and permissions for Customer Data
  • Provide all legally required privacy notices to end users
  • Comply with privacy, data security, consumer protection, payment, tax, marketing, SMS, email, accessibility, auto-renewal, and other applicable laws
  • Maintain the security of their accounts and devices
  • Ensure staff and admins use the Services properly
  • Promptly handle end user questions, complaints, disputes, refunds, cancellations, chargebacks, and membership issues
  • Not use the Services for fraudulent, unlawful, misleading, deceptive, unfair, or abusive purposes
  • Ensure physical signage, QR codes, checkout instructions, and customer-facing disclosures are accurate and not misleading
  • Ensure their car wash operations, equipment, premises, safety procedures, and customer service comply with applicable law

Operators are solely responsible for the accuracy and legality of all pricing, packages, offers, membership plans, taxes, fees, disclosures, refund policies, cancellation policies, and customer-facing terms they configure, approve, display, or use in the Services.

End User Responsibilities

End users agree to:

  • Provide accurate account and payment information
  • Use the Services only for lawful purposes
  • Review Operator disclosures before purchasing or enrolling in memberships
  • Maintain the security of account credentials and devices
  • Comply with Operator rules, location restrictions, and membership terms
  • Not misuse QR codes, payment features, promotions, or account tools

QR Checkout, Payments, and Memberships

The Services may allow end users to scan QR codes, select wash packages, purchase washes, join memberships, and manage accounts through mobile workflows. Operators control the offerings, pricing, and customer-facing terms displayed through those workflows.

Wash Hub does not guarantee that any QR code, checkout flow, membership plan, or promotional configuration will produce a particular business result.

Payment Processing

Payments may be processed by third-party Payment Processors. By using payment features, you agree to the applicable Payment Processor terms and authorize charges, refunds, reversals, and recurring billing as permitted by these Terms, Operator terms, and applicable law.

Wash Hub is not a bank, money transmitter, or card issuer. Payment processing is subject to Payment Processor rules, card network rules, and applicable financial regulations.

Fees, Subscriptions, and Billing

Operators may be charged fees for use of the Services according to the pricing plan, order form, or other written agreement between the Operator and Wash Hub. Fees may include subscription fees, transaction fees, setup fees, or other charges disclosed at signup or in a separate agreement.

Unless otherwise stated in writing, fees are non-refundable except where required by law.Wash Hub may change fees with notice as permitted by agreement or applicable law.

Massachusetts Fee Disclosure and Consumer Protection Requirements

Operators are solely responsible for ensuring that all pricing, fees, charges, memberships, subscriptions, promotions, discounts, taxes, and checkout disclosures presented to end users are accurate, complete, current, and compliant with applicable law.

Where Massachusetts law applies, Operators are responsible for compliance with Massachusetts consumer protection requirements, including requirements relating to unfair or deceptive acts or practices, price advertising, fee disclosures, membership disclosures, recurring billing disclosures, cancellation terms, and refund policies.

Operators agree that they will not use Wash Hub to:

  • Misrepresent the total price of a wash, membership, subscription, package, product, or service
  • Hide required fees or charges
  • Add undisclosed fees late in checkout
  • Misrepresent discounts or promotions
  • Fail to clearly disclose recurring billing terms
  • Fail to clearly disclose cancellation terms
  • Misrepresent taxes, government charges, or processing fees
  • Mislead customers about membership benefits, restrictions, renewal terms, or cancellation rights
  • Use deceptive countdowns, false scarcity, misleading "free" offers, or misleading trial offers
  • Configure pricing or package information that violates applicable consumer protection laws

Operators must ensure that the total price and all material terms are disclosed clearly and conspicuously before an end user completes a purchase, joins a membership, or submits payment information.

Wash Hub may provide tools for configuring pricing, fees, packages, and memberships, but Operators are solely responsible for the legality, accuracy, and presentation of their own customer-facing terms.

Wash Hub may suspend or remove any pricing, offer, package, membership, or configuration that Wash Hub believes may create legal, regulatory, payment processor, consumer protection, reputational, or operational risk.

Taxes

Operators are solely responsible for determining, collecting, reporting, and remitting all taxes applicable to their car wash services, memberships, and transactions, except where Wash Hub expressly agrees otherwise in writing.

Wash Hub may provide tax configuration tools, but Operators remain responsible for the accuracy of tax settings and compliance with applicable tax law.

Refunds, Cancellations, and Chargebacks

Operator refund, cancellation, and membership policies are controlled by the applicable Operator unless otherwise stated in a separate written agreement.

Wash Hub may provide tools that allow Operators or end users to manage cancellations, refunds, payment method updates, or account changes, but Wash Hub is not responsible for the Operator’s underlying customer policies, legal disclosures, service decisions, or customer support obligations.

Operators are responsible for:

  • Refund decisions
  • Membership cancellation handling
  • Customer disputes
  • Chargebacks
  • Payment reversals
  • Fraud claims
  • Failed payment follow-up
  • Consumer protection compliance
  • Massachusetts unfair or deceptive practice compliance where applicable
  • Auto-renewal and recurring billing compliance
  • Ensuring cancellation instructions are clear and honored where required by law

Wash Hub may deduct or recover amounts associated with refunds, chargebacks, payment disputes, payment processor fees, penalties, taxes, or other charges from amounts owed to an Operator where permitted by agreement or law.

Auto-Renewing Memberships and Recurring Billing

Wash Hub may provide tools that allow Operators to offer recurring car wash memberships, subscriptions, or other automatically renewing plans.

Operators are solely responsible for ensuring that all membership and recurring billing terms comply with applicable federal, Massachusetts, and other state laws.

Operators agree to clearly and conspicuously disclose, before enrollment:

  • The membership price
  • Billing frequency
  • Renewal terms
  • Trial terms, if any
  • Cancellation process
  • Refund policy
  • Usage restrictions
  • Location restrictions
  • Vehicle restrictions
  • Any taxes, fees, or other charges
  • Whether the plan renews automatically
  • How the customer can update payment information
  • How the customer can cancel

End users authorize recurring charges by enrolling in a membership or recurring plan through a Wash Hub-powered workflow.

Operators are responsible for honoring cancellation requests, refund policies, customer support obligations, and any legally required notices.

Wash Hub is not responsible for an Operator’s failure to properly disclose, administer, cancel, refund, or honor a membership unless caused solely by Wash Hub’s own willful misconduct or a separate written agreement provides otherwise.

Acceptable Use

You agree to use the Services only in compliance with these Terms, applicable law, and applicable Payment Processor and integration rules. You may not use the Services in a manner that interferes with the Services, compromises security, or harms Wash Hub, Operators, end users, or third parties.

Prohibited Activities

You may not:

  • Violate law or third-party rights
  • Upload malware, malicious code, or unlawful content
  • Attempt unauthorized access to systems, accounts, or data
  • Reverse engineer or copy the Services except as permitted by law
  • Use the Services for fraud, money laundering, or deceptive practices
  • Collect unnecessary sensitive personal information
  • Circumvent security, rate limits, or access controls
  • Resell or sublicense the Services except as authorized in writing
  • Use the Services to send unlawful spam or unauthorized marketing messages

Customer Data and Operator Data

Operators retain ownership of Customer Data and Operator Data, subject to the rights granted to Wash Hub in these Terms. Operators grant Wash Hub a limited license to host, process, transmit, display, and use Customer Data and Operator Data as necessary to provide, secure, support, and improve the Services.

Operators represent that they have provided all required notices and obtained all required consents for the collection and use of Customer Data through the Services.

Data Processing and Privacy

Our collection and use of information is described in the Privacy Policy. Where Wash Hub processes personal information on behalf of an Operator, the parties may be subject to additional data processing terms in a separate written agreement.

Massachusetts Data Security and Breach Cooperation

Operators and Wash Hub may each have obligations under Massachusetts privacy, data security, breach notification, and record disposal laws depending on their role and the information involved.

Operators agree to:

  • Provide all legally required privacy notices to end users
  • Obtain all legally required consents
  • Use Wash Hub in compliance with applicable privacy and data security laws
  • Maintain reasonable safeguards for their own systems, staff, devices, credentials, networks, customer records, and physical locations
  • Notify Wash Hub promptly of any suspected unauthorized access, breach, credential compromise, misuse, or security incident involving the Services
  • Cooperate with Wash Hub in investigating and responding to suspected security incidents
  • Not upload unnecessary sensitive information into the Services
  • Not use the Services to collect Social Security numbers, driver’s license numbers, state ID numbers, bank account numbers, or other sensitive information unless expressly authorized and legally necessary

If Wash Hub processes personal information on behalf of an Operator, Wash Hub may assist the Operator with security incident investigation and breach response as required by applicable law, contract, or written data processing terms.

Wash Hub may suspend access or disable credentials if Wash Hub believes continued access may create security, legal, payment, privacy, or operational risk.

Security

Wash Hub uses reasonable safeguards designed to protect the Services and information processed through them. However, no system is completely secure. You are responsible for maintaining appropriate security practices for your accounts, devices, integrations, and physical locations.

Third-Party Services and Integrations

The Services may integrate with or link to third-party services, including Payment Processors, POS systems, gate controllers, email providers, SMS providers, analytics tools, and other platforms. Wash Hub does not control and is not responsible for third-party services. Your use of third-party services is subject to their own terms and policies.

Hardware, Equipment, Gates, POS, and Wash Systems

Wash Hub provides software and digital workflows. Unless expressly agreed in a signed written agreement, Wash Hub does not manufacture, install, own, maintain, inspect, repair, warrant, operate, or control:

  • Physical car wash equipment
  • Payment stations
  • Gates
  • Tunnel controllers
  • POS systems
  • License plate recognition systems
  • Cameras
  • Kiosks
  • Signage
  • Networking equipment
  • Electrical systems
  • Internet connectivity
  • Wash tunnels
  • Vacuums
  • Chemicals
  • Water systems
  • Site safety systems
  • Any other on-site hardware or equipment

Wash Hub does not guarantee compatibility with any specific hardware, POS system, payment station, gate, tunnel controller, payment terminal, camera, license plate recognition system, or third-party service unless expressly stated in a signed written agreement.

Operators are solely responsible for ensuring their physical site, equipment, connectivity, signage, QR code placement, customer instructions, safety practices, and operations are safe, functional, compliant, and suitable for use with Wash Hub.

Wash Hub is not responsible for vehicle damage, personal injury, property damage, equipment failures, gate failures, payment station failures, wash quality issues, tunnel issues, premises liability, customer accidents, operator negligence, staff conduct, signage errors, or physical site conditions.

Service Availability and Changes

Wash Hub may modify, suspend, or discontinue any part of the Services at any time. We do not guarantee uninterrupted availability. Scheduled maintenance, outages, third-party failures, and force majeure events may affect access to the Services.

Beta Features

Wash Hub may offer beta, preview, or experimental features. These features are provided as-is, may change without notice, and may be less reliable than production features. Use of beta features is at your own risk.

Intellectual Property

Wash Hub and its licensors own all rights, title, and interest in the Services, software, branding, documentation, and related intellectual property, except for Customer Data, Operator Data, and third-party materials. No rights are granted except as expressly stated in these Terms.

Operators grant Wash Hub a limited license to use their name, logo, and non-confidential account information for support, billing, and agreed marketing purposes.

Feedback

If you provide suggestions, ideas, or feedback about the Services, you grant Wash Hub a perpetual, irrevocable, royalty-free license to use that feedback without restriction or compensation, except where prohibited by law.

Confidentiality

Each party may receive confidential information from the other. The receiving party will use reasonable care to protect confidential information and use it only for purposes related to the Services, except as otherwise permitted by law or with consent.

Marketing Rights

Unless otherwise agreed in writing, Wash Hub may identify Operators as customers and use non-confidential Operator names and logos in marketing materials, websites, and presentations. Operators may opt out of public marketing use by contacting [LEGAL EMAIL].

Compliance with Laws

You agree to comply with all applicable laws, regulations, rules, and industry requirements, including those related to:

  • Consumer protection
  • Massachusetts unfair or deceptive practices laws
  • Pricing and fee disclosures
  • Advertising and promotions
  • Payments
  • Taxes
  • Privacy and data protection
  • Data security
  • Breach notification
  • Record disposal
  • Email marketing
  • SMS/text messaging
  • Auto-renewing subscriptions
  • Accessibility
  • Car wash operations
  • Local permits and business licensing
  • Employment and staff access
  • Safety and premises liability
  • Payment processor rules
  • Card network rules

Operators are solely responsible for compliance with laws applicable to their car wash business, locations, customer relationships, products, memberships, prices, fees, taxes, refund policies, cancellation policies, marketing, and physical operations.

Massachusetts Consumer Protection and Operator Conduct

Operators acknowledge that Massachusetts law prohibits unfair or deceptive acts or practices in trade or commerce. Where Massachusetts law applies, Operators are responsible for ensuring that their car wash services, pricing, packages, memberships, offers, promotions, cancellation policies, refund policies, fee disclosures, and customer communications comply with applicable Massachusetts consumer protection requirements.

Operators agree not to use Wash Hub in any manner that could reasonably be considered unfair, deceptive, misleading, fraudulent, abusive, or unlawful.

Operators are solely responsible for any claims, complaints, investigations, demands, penalties, settlements, judgments, damages, fees, or expenses arising from their own business practices, customer-facing disclosures, pricing, fees, membership terms, refund practices, cancellation practices, marketing, physical car wash operations, or customer disputes.

Nothing in these Terms is intended to waive any non-waivable consumer rights under Massachusetts law or other applicable law.

Disclaimers

To the maximum extent permitted by Massachusetts law and other applicable law, the Services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, statutory, or otherwise.

Wash Hub disclaims all warranties, including:

  • Implied warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy
  • Availability
  • Reliability
  • Security
  • Error-free operation
  • Compatibility with any hardware, equipment, POS system, payment station, gate, controller, payment processor, or third-party service
  • Any guarantee of revenue, profit, membership growth, conversion rate, customer retention, wash volume, customer satisfaction, or business outcome

Wash Hub does not warrant that the Services will meet your requirements, operate without interruption, be secure, be free of errors, or produce any particular business result.

Nothing in these Terms excludes warranties or rights that cannot be excluded under applicable law.

Limitation of Liability

To the maximum extent permitted by Massachusetts law and other applicable law, Wash Hub and its owners, officers, directors, employees, contractors, agents, affiliates, suppliers, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, enhanced, or punitive damages, including lost profits, lost revenue, lost business, loss of goodwill, loss of data, business interruption, equipment failure, customer disputes, vehicle damage, personal injury, property damage, chargebacks, payment processor issues, tax issues, consumer complaints, or cost of substitute services.

To the maximum extent permitted by law, Wash Hub’s total liability for any claim arising out of or relating to the Services or these Terms will not exceed the greater of:

  1. The amount paid by you to Wash Hub for the Services giving rise to the claim during the three months before the event giving rise to liability; or
  2. One hundred dollars.

The limitations in this section apply regardless of the theory of liability, whether based in contract, tort, negligence, strict liability, statute, warranty, or otherwise, even if Wash Hub has been advised of the possibility of damages.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply.

Indemnification

To the maximum extent permitted by Massachusetts law and other applicable law, you agree to defend, indemnify, and hold harmless Wash Hub and its owners, officers, directors, employees, contractors, agents, affiliates, suppliers, and licensors from and against all claims, demands, damages, liabilities, losses, judgments, settlements, penalties, fines, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of law
  • Your business operations
  • Your car wash services
  • Your physical premises
  • Your equipment, gates, tunnel controllers, POS systems, payment stations, signage, internet, cameras, or other site systems
  • Vehicle damage, property damage, personal injury, or premises liability claims at your location
  • Your products, packages, pricing, promotions, memberships, refunds, cancellations, fee disclosures, or customer policies
  • Your relationship with end users
  • Your failure to provide required notices or obtain required consents
  • Your collection, use, disclosure, or processing of Customer Data
  • Your failure to comply with Massachusetts privacy, data security, breach notification, record disposal, consumer protection, fee disclosure, or unfair/deceptive practices laws
  • Your tax obligations
  • Chargebacks, refunds, disputes, payment reversals, or fraud claims
  • Fraudulent or unauthorized transactions
  • Your misuse of payment features
  • Your negligence, willful misconduct, or wrongful acts
  • Your content, trademarks, logos, photos, offers, marketing materials, or other materials
  • Any allegation that Operator Data or your content infringes or violates third-party rights
  • Any dispute between you and an end user
  • Any regulatory inquiry, complaint, demand, investigation, or enforcement action arising from your business practices or use of the Services

Wash Hub reserves the right to control the defense of any matter subject to indemnification. You agree to cooperate with the defense of such claims.

You may not settle any indemnified claim in a manner that imposes liability, admission of wrongdoing, or obligation on Wash Hub without Wash Hub’s prior written consent.

Release

To the maximum extent permitted by Massachusetts law and other applicable law, you release Wash Hub from claims, demands, damages, losses, liabilities, and disputes arising out of or related to:

  • Operator car wash services
  • End user disputes
  • Vehicle damage
  • Personal injury
  • Property damage
  • Site safety
  • Equipment failures
  • Payment station issues
  • Gate or controller issues
  • Wash quality
  • Membership policies
  • Refunds and cancellations
  • Chargebacks
  • Third-party services
  • Payment processor decisions
  • Operator-configured pricing, packages, offers, disclosures, or terms
  • Operator marketing, advertising, SMS, or email communications
  • Operator failure to comply with Massachusetts or other applicable laws

Nothing in this release waives claims that cannot legally be waived under Massachusetts law or other applicable law.

Suspension and Termination

Wash Hub may suspend or terminate access to the Services immediately if we reasonably believe you have violated these Terms, created legal or security risk, failed to pay amounts due, or if required by law or a Payment Processor.

You may stop using the Services at any time. Termination does not relieve you of obligations that accrued before termination.

Effect of Termination

Upon termination, your right to access the Services ends. Sections that by their nature should survive termination will survive, including provisions relating to fees, Customer Data handling, confidentiality, disclaimers, limitation of liability, indemnification, release, governing law, and dispute resolution.

Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles.

The Federal Arbitration Act may govern the interpretation and enforcement of the arbitration agreement below where applicable.

Nothing in these Terms limits any non-waivable consumer protection rights that may apply under Massachusetts law or another applicable jurisdiction.

Dispute Resolution, Arbitration, Class Action Waiver, and Jury Trial Waiver

Read this section carefully. It affects your legal rights.

To the maximum extent permitted by Massachusetts law and other applicable law, you and Wash Hub agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding arbitration rather than in court, except that either party may bring claims in small claims court if eligible and either party may seek injunctive or equitable relief in court for intellectual property misuse, unauthorized access, security incidents, confidentiality violations, or misuse of the Services.

Arbitration will be conducted by a neutral arbitrator under rules selected by Wash Hub or as otherwise required by applicable law. The arbitration will take place in [MASSACHUSETTS COUNTY], Massachusetts, unless the parties agree otherwise or remote arbitration is permitted.

You and Wash Hub agree to bring claims only on an individual basis and not as a plaintiff, class member, or representative in any class, collective, consolidated, private attorney general, or representative proceeding.

The arbitrator may award relief only on an individual basis.

To the maximum extent permitted by law, you and Wash Hub waive any right to a jury trial.

If the class action waiver is found unenforceable, the entire arbitration provision may be void unless otherwise required by law.

Massachusetts Venue for Non-Arbitrable Claims

For any claim that is not subject to arbitration, the parties agree to the exclusive jurisdiction and venue of the state or federal courts located in the Commonwealth of Massachusetts.

For state court claims, venue will be in [MASSACHUSETTS COUNTY], Massachusetts, unless applicable law requires otherwise.

Each party consents to personal jurisdiction in Massachusetts for such claims.

Export and Sanctions Compliance

You may not use the Services in violation of U.S. export control or sanctions laws. You represent that you are not located in, organized in, or controlled by a person or entity subject to applicable sanctions restrictions.

Force Majeure

Wash Hub is not liable for delay or failure to perform due to events beyond its reasonable control, including natural disasters, internet outages, labor disputes, acts of government, war, terrorism, or third-party service failures.

Assignment

You may not assign these Terms without Wash Hub’s prior written consent, except in connection with a merger, acquisition, or sale of substantially all assets, subject to notice. Wash Hub may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.

Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

No Waiver

Failure by Wash Hub to enforce any provision of these Terms is not a waiver of that provision or any other provision.

Entire Agreement

These Terms, together with the Privacy Policy and any written order form or agreement between you and Wash Hub, constitute the entire agreement regarding the Services and supersede prior or contemporaneous understandings on that subject, except that non-waivable rights under applicable law remain unaffected.

Changes to Terms

Wash Hub may update these Terms from time to time. If we make material changes, we will provide notice as required by law, such as by posting the updated Terms and updating the effective date. Continued use of the Services after the effective date may constitute acceptance of the updated Terms, subject to applicable law.
